Holiday Unit Terms and Conditions
Terms and conditions for the booking and use of ANMFWA Holiday Accommodation
By making a booking you agree to enter into an agreement to rent the Premises from the ANMFWA in accordance with these Terms and Conditions. It is your responsibility to read these Terms and Conditions before making a booking.
In these Terms and Conditions, "Premises" means the holiday unit you have booked, together with the common property of the complex in which it is located.
1. Bookings
-
Bookings can be made by ANMFWA members for themselves and their guests.
-
The member who makes the booking must be present in the accommodation throughout the duration of the booking.
-
No bookings for School Leavers.

-
If an ANMFWA member becomes unfinancial before or after making a booking, or resigns their membership, the ANMFWA reserves the right to cancel all bookings made by that member. In that case, the booking fee will be refunded minus a cancellation fee.

-

4. Allocation of Apartment
Members may choose their own holiday apartment from the available list at the time of booking.
The ANMFWA may change the allocation of an apartment at any time from booking up until the arrival date and time. The ANMFWA will make every effort to advise the member of the new booking arrangements.
5. Members’ Responsibility
-
The ANMFWA reserves the right to change all, or part, of these Terms and Conditions at any time. It is your responsibility to keep yourself updated on any changes.
-
You must ensure your guests and visitors also abide by these Terms and Conditions. A breach by your guests will be considered a breach by you.
-
A breach of these Terms and Conditions may result in, but is not limited to, you being evicted from the Premises.
-
Your credit card details will only be used to pay for amounts relating to your booking where directed by you. This information will never be supplied to any third party and will not be used for any other purpose.
-
If the Premises are damaged due to the negligence or wilful act of you, your guests or invitees, the Premises will be repaired by the ANMFWA at your cost.
-
Use of the Premises for any event, or for anything other than residential holiday accommodation, will result in the immediate termination of the booking and the removal of all occupants from the Premises. Costs or expenses incurred will be charged to the member’s credit card. If insufficient funds are available, the debt will be passed to a debt collection agency or to the courts, plus recovery costs.
-
Members and their guests must be courteous and respectful to all members of the Holiday Unit Team, including cleaners and on-site support staff. Any abuse of the Holiday Unit Team may result in a ban from future use of the ANMFWA holiday units.
-
Information regarding a booking (such as key collection and drop off) may change without notice and it is the member’s responsibility to keep up to date. The ANMFWA will make every effort to communicate changes to affected members but will not accept responsibility for information not read correctly.
6. Conditions of Occupancy
Use of Premises
To maintain a good standard for all guests, the following conditions apply to all ANMFWA holiday units. These conditions extend to the common property of each complex.
-
You and your guests must comply with the by-laws, house rules and any reasonable directions given by the ANMFWA, the facility manager or members of the strata company’s council.
-
On departure, the Premises must be left in a similar condition to how they were on arrival. Failure to do so will result in additional charges, and you authorise the ANMFWA to deduct these costs from your credit card.
-
You must not use the Premises for any unlawful purpose.
-
Disturbance to neighbours, including excessive noise, is strictly prohibited. The units are in residential areas and regard must be paid to the enjoyment of neighbouring properties.
-
You must only occupy the apartment allocated to you. If you occupy another apartment for any reason, you will be asked to return to your booked apartment, and if you fail to comply you may be banned from future use of the units. If the ANMFWA State Secretary determines that moving back would cause further disruption to other guests, the member may be allowed to stay in the new apartment, but a $100 administration fee will be charged.
Members and their guests must:
-
keep noise at a reasonable level, particularly between 10pm and 8am;
-
comply with parking regulations and show consideration to neighbours and other vehicles;
-
dispose of garbage and recycling in the allocated bins and not leave excess rubbish in common or public areas;
-
notify reception of any complaints as soon as practicable;
-
minimise their impact on the residential amenity of neighbours and the local community;
-
be responsible for their visitors;
-
observe and abide by all strata by-laws and house rules;
-
maintain the security of the Premises;
-
abide by any noise abatement order issued by police or any regulatory authority; and
-
refrain from drunken, obscene or antisocial behaviour.
Breach of Conditions of Occupancy
A failure to comply with any of these conditions may be considered a serious breach of this agreement and may result in your eviction.
7. Rules During Your Stay
Non-Smoking
All ANMFWA units are strictly non-smoking, including balconies and patio areas. Members and guests must not smoke within 5 metres of any entrance, window or patio area of an ANMFWA unit. A ban may apply if this policy is breached.
Pets
Pets are not permitted at ANMFWA holiday units. This does not apply to qualified assistance dogs where a certificate is provided.
Bicycles and Scooters
Bicycles and scooters of any description are not permitted inside any ANMFWA apartment.
Electric Vehicle Charging
Members and their guests must not charge electric vehicles using power from the units or the complex. This includes running extension leads or electrical cords from any unit, balcony, common area, laundry, external power point or any other power source on the property. Cords and leads run across walkways, driveways or common property create a trip and electrical safety hazard and will be removed without notice.
Any breach of this clause will be treated as a serious breach of these Terms and Conditions. The member may be charged for any electricity used and for any damage caused, and may be banned from future use of the ANMFWA holiday units. Guests with electric vehicles are encouraged to use nearby public charging stations.
Moving Furniture
You may move furniture during your stay but must return everything to its original position before checking out.
Defects During Your Stay
If anything is broken, missing or not clean when you arrive, please notify reception.
Balconies
For your safety, if there are one or more balconies at the Premises, you, your guests and invitees must observe the following rules:
-
A maximum of four (4) people are allowed on a balcony at any one time.
-
Do not climb on, sit on, push or use strong force against the railings.
-
Avoid any behaviour that may damage the Premises, the balcony or its safety features.
-
Avoid any behaviour that may cause a person to injure another person or themselves, or cause someone or something to fall from the balcony.
-
Do not go out on the balcony if you are under the influence of alcohol or drugs.
-
Ensure all balcony doors are locked before you leave the Premises.
If children or persons with welfare concerns are visiting or staying at the Premises, ensure they are supervised at all times when using the balcony. At all other times, the ANMFWA highly recommends that doors providing access to the balcony are kept locked.
Pool and Gym Areas
-
Glass or glass products are not permitted in these areas. This condition is strictly enforced.
-
Children under 12 must only use the pool when accompanied by an adult.
-
Where a gym is provided, its use is restricted to adults.
Parking
-
Members, guests and invitees must only park in designated areas and clear of driveways. Do not park on grass or in areas not marked for parking.
-
Visitors may only park in areas set aside for visitor parking.
-
The ANMFWA is not responsible for any fines imposed for non-compliance with parking rules.
Specific rules for boats, trailers, caravans and other vehicles at each location are set out in sections 14 and 15.
8. Cleaning on Departure
On vacating, the member is responsible for ensuring:
-
the fridge, pantry and cupboards are cleared of all food, drinks and anything else you have put there during your stay;
-
all pots, pans, cutlery, glassware, crockery and other kitchen utensils are clean, dry and put away;
-
the microwave and oven are left in the same condition as you found them;
-
TV remote controls are left on the TV cabinet;
-
all lights and air-conditioners are turned off; and
-
all keys and/or keycards are returned to reception on departure.
9. Parties and Other Entertaining
The ANMFWA has a zero-tolerance policy on parties and functions at the Premises. The booking fee is for private domestic holiday use only and does not allow for the extra costs of functions such as cleaning, garbage removal, wear and tear and repairs. A party is defined as:
-
any situation where the maximum number of guests allowed at the Premises is exceeded;
-
any situation where noise from the Premises is deemed too high and disturbs other guests or residents;
-
any situation where excessive traffic to and from the Premises is identified;
-
any situation where intoxication is deemed to be occurring; or
-
any situation where excessive alcohol is identified as being present.
If a member is identified as holding a party at the Premises, the ANMFWA reserves the right to immediately require all occupants of the unit(s) to vacate. In that case the total booking fee will be forfeited, and any expense resulting from additional cleaning, replacement of furniture, fixtures or breakages, lost keys and repairs will be charged to your credit card. The member may also be banned from using the holiday units for a specific period.
10. Eviction
The ANMFWA reserves the right to immediately evict any member, guest, visitor or member of the public for reasons including, but not limited to:
-
intoxication and/or unsavoury or lewd behaviour;
-
throwing objects off any balcony or from the Premises;
-
spitting or vomiting over balconies;
-
wilful damage to the Premises or surrounding property;
-
physical or verbal abuse or assault of staff, other guests, residents or members of the public on or around the Premises;
-
any behaviour deemed a potential safety threat to others;
-
any breach of these Terms and Conditions, including the alcohol or party policy; or
-
any incident requiring police attendance.
11. Access, Repairs and Refunds
Access to Units for Repairs, Maintenance and Inspections
The ANMFWA makes every effort to carry out repairs and maintenance when units are unoccupied. Where this is not possible, the ANMFWA retains the right for its employees and contractors to enter the units at any time during a booking for maintenance, repairs or inspections to ensure compliance with these Terms and Conditions. The ANMFWA will make every effort to do this at times that least inconvenience the member.
Any failure by a member to allow access, or any attempt to block access to ANMFWA staff or contractors, may result in a ban from future use of the ANMFWA holiday units.
Refund if the ANMFWA Terminates Your Booking
If the Premises become unavailable for occupancy before or during your stay for any reason (for example damage to the Premises, emergency repairs or any other eventuality), the ANMFWA will refund the money paid for the whole or part of the booking not fulfilled, unless the damage was caused by you or your guests.
12. Loss, Damage, Injury and Extra Charges
You are responsible for any damage, breakage, theft or loss of any property on or in the Premises during your booking, including by your guests. You will be responsible for all related costs of repair or replacement, and you authorise the ANMFWA to charge your credit card accordingly.
The ANMFWA does not take any responsibility for the loss or theft of your personal property, or for any bodily injury that occurs on or at the Premises.
In addition to the published tariffs and fees, which must be paid in full before you enter the Premises, the following charges may apply:
-
all costs for the repair or replacement of damaged, lost or stolen property on or at the Premises while under your care; and
-
a $125 fee if the unit key or keycard is not returned on departure. If the key or keycard is returned within 14 days, $75 of this fee will be refunded.
13. Information About the Premises
While the ANMFWA makes every effort to keep information current, it may change without notice. Descriptions of the Premises are made in good faith and the ANMFWA does not accept responsibility for misdescription. Photographs were taken on site, are a guide only, and are subject to change through fair wear and tear. The ANMFWA does not accept responsibility for personal perceptions or for errors or omissions on the website.
If a particular feature or facility is essential to your choice of unit, please confirm it with reservations at the time of booking. The ANMFWA cannot be held liable for omissions or errors, whether temporary or permanent, about the property’s facilities and services.
If appliances or inclusions fault or malfunction, the ANMFWA has no obligation to compensate or discount and will not accept responsibility for any inconvenience. In such circumstances, the ANMFWA will use best endeavours to repair, replace or hire an alternative.
